Your Right to Adequate Meal and Rest Breaks
California workers have a right to adequate meal and rest periods. As a general rule, California employees must receive a 30 minute daily meal period for a shift that is five hours or more. Employees are also entitled to a 10 minute paid rest period for ever three and one-half to four hours they work.
For one or more meal period violations that have occurred in a day, an employee may receive compensation in the amount of one hour of regular pay. Similarly, for one or more rest period violations, an employee may receive compensation in the amount of one hour of regular pay.
